Terms of Service

These Terms and Conditions ("Terms") govern your access to and use of ExamHero, a multi‑exam study platform that provides preparation content and tools for exams including (without limitation) CELPIP, IELTS, OET, TOEFL, and PTE. Exam names belong to their respective owners; ExamHero is independent and not officially affiliated with any test administrator.

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

The Service is intended for individuals 18 years of age or older (or the age of majority where you live, if higher). If you are under that age, do not use the Service or submit Personal Data. (If you represent an educational institution seeking supervised minor access, contact us to discuss a separate agreement.)

If the Service offers or requires an account:

• Keep your login credentials confidential.
• You are responsible for all activity under your account.
• Notify us immediately if you suspect unauthorized use.

Certain features require payment (one‑time purchase or subscription).

App Store Platforms: Purchases are processed through Apple App Store and/or Google Play. We do not process or store full payment card details.
• Subscription Management: Renewals, cancellations, refunds, and billing disputes are governed by the store’s policies. Manage or cancel from your device account settings.
• RevenueCat: We use RevenueCat to help reconcile subscription status across platforms; limited purchase metadata may be shared with RevenueCat.
• Promotions: Promotional pricing or trial periods may auto‑convert to a paid subscription unless canceled before the end of the trial, subject to platform rules.

Subject to your compliance with these Terms, Devxpert Inc. grants you a limited, revocable, non‑exclusive, non‑transferable license to download and use the app for personal, non‑commercial study purposes.

You may not: copy content at scale, resell access, reverse engineer, extract datasets, or use the Service to build competing training products without written permission.

If you submit text, audio, or other materials (collectively, "User Content") into the Service:

• You retain ownership of your content.
• You grant Devxpert Inc. a non‑exclusive, worldwide, royalty‑free license to host, process, display, and analyze that content solely to operate, improve, secure, and provide the Service (including AI features).
• You represent you have rights to the content and that it does not infringe third‑party IP or privacy rights, or violate law.

You agree not to:

• Use the Service for unlawful, fraudulent, or abusive purposes.
• Upload malware, attempt to hack, scrape, or overload our systems.
• Misrepresent your identity or impersonate others.
• Share exam content in violation of official test copyright.

All ExamHero software, UI/UX design, logos (other than third‑party exam names), study materials we create, and related intellectual property are owned by or licensed to Devxpert Inc. Unauthorized reproduction or distribution is prohibited.

Third‑party exam names and logos referenced in the Service remain the property of their respective owners. Use within ExamHero is nominative and for identification only.

The Service may link to external content (videos, docs, official exam sites). We are not responsible for third‑party content, privacy practices, or availability. Review those parties’ terms before engaging.

We may suspend or terminate access at our discretion, including for violation of these Terms, misuse, suspected fraud, or technical/security risk. Upon termination, rights granted to you under these Terms cease immediately. Sections that by nature should survive (IP, indemnity, disclaimers, liability limits, governing law) will remain in effect.

You agree to defend, indemnify, and hold harmless Devxpert Inc., its affiliates, officers, employees, and agents from and against claims, damages, obligations, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of third‑party rights.

To the maximum extent permitted by law, Devxpert Inc. shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, goodwill, or study results, arising out of or related to your use of (or inability to use) the Service—even if advised of the possibility.

Where liability cannot be fully excluded, our total aggregate liability to you will not exceed the greater of (i) the total fees you paid to us for the Service in the six (6) months preceding the claim, or (ii) CAD $50.

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, accuracy, or non‑infringement. We do not warrant that the Service will be uninterrupted, secure, error‑free, or that results (including exam scores) will meet your expectations.

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict‑of‑law principles. Where consumer protection laws in your jurisdiction require otherwise, those protections will apply.

We may update these Terms from time to time. When changes are material, we will provide reasonable notice (e.g., in‑app banner, email, or version release notes). Continued use after changes become effective constitutes acceptance of the revised Terms.
